www.acellars.com.au (called “Annandale Cellars”) is the online liquor operation of Annandale Cellars Pty Ltd (Annandale Cellars)(Liquor Licence LIQP700350083).
This Agreement is the entire agreement between you and Annandale Cellars for the purchase and supply of goods and related products. The terms and conditions under which you may purchase goods from Annandale Cellars are set out below, and are applicable to all online purchases.
Please read the following terms and conditions prior to placing your order with Annandale Cellars. By using this website you acknowledge that you have read, understood and agree to be bound by these Terms and Conditions.
Annandale Cellars reserves the right at any time to modify, alter or update these Terms and Conditions of sale and you agree to be bound by such modifications, alterations or updates on subsequent visits.
The Agreement is deemed to be entered in New South Wales and is subject to its laws unless otherwise specified.
Age & liquor restrictions
By registering as a customer or a guest on this website you are verifying that you are over 18 years of age. Any purchase or attempt to purchase made by or on behalf of a person under the age of 18 is illegal. You agree to abide by the associated licencing laws of the state or territory in which you reside and you agree that illegally purchasing or attempting to purchase from Annandale Cellars may result in fines and convictions.
Definitions:
“adult’ means a person aged 18 years or over
“buyer” means any person, firm or company buying goods from Annandale Cellars
“freight carrier” means third party goods carriers contracted by Annandale Cellars to deliver goods to the buyer’s delivery address from time to time, including Australia Post
“goods” means liquor and other goods described in an order and includes packaging
“order” means an order by you to purchase goods from Annandale Cellars
“personal details” includes, but is not limited to, your name, email address, delivery address and payment details.
“physical stores” means Annandale Cellars
“Privacy Policy” means the Privacy Policy described on this Annandale Cellars website; and is part of these Terms and Conditions
“seller” means Annandale Cellars and includes the terms “us”, “we” and “our”
When do we agree
The Agreement exists between you and us once Annandale Cellars receives and accepts an order. No obligation to sell or supply the goods will arise until the order is received and accepted, and each order may be accepted in its absolute discretion. Each order is a separate agreement.
Orders
You may place an order with Annandale Cellars by:
a) Selecting goods on the www.acellars.com.au website, entering your personal details and submitting your order for payment. The order will be received by us and deemed as placed once a successful payment has been processed, or
b) Instructing Annandale Cellars by telephone that you wish to purchase the goods, and providing your personal details to us or an authorised agent of Annandale Cellars, including one of the physical stores; or
c) Instructing Annandale Cellars by facsimile or personal mail that you wish to purchase the goods, and providing your personal details to facilitate the purchase.
Delivery
Annandale Cellars delivers Australia wide.
We do not usually deliver to addresses outside Australia due to complex international liquor laws and taxes and the expense of shipping. Should you require your order to be shipped outside Australia please contact Annandale Cellars and discuss your order with us.
We will dispatch your order in a timely fashion, generally within 48 hours of receiving confirmation of your order. Delivery times vary depending on your location. If you are located in a capital city of Australia you can expect delivery within 48 hours of dispatch.
In some extraordinary circumstances delivery may not be possible to some very remote locations or may result in an extended period being required to fulfil an order. We will make every effort to contact you in the event of inability or delay and discuss alternative options with you.
Annandale Cellars will not be responsible for unfulfilled orders resulting from incorrect or out of date personal information details.
It is a requirement of NSW Packaged Liquor Licence Laws that we do not make same-day deliveries.
Annandale Cellars deliveries undertaken by a contracted freight carrier are bound by that freight carrier’s own Privacy Policy.
Freight cost is included in your order value total at the time of payment.
Freight cost is calculated based on, weight and quantity of parcels being shipped and varies dependent upon the destination postcode.
Goods delivered to you can be exposed to extremes of temperature, which can be detrimental to their quality, and this risk to the integrity of the goods during transit remains with you.
The buyer or an authorised adult are to be present to take receipt of the goods, unless otherwise authorised by you. Our contracted freight carrier will only leave the goods if you or your nominated adult is not present to take receipt, if prior explicit written or email consent is received before the delivery attempt. Neither Annandale Cellars nor its contracted freight carrier will be held responsible for loss or damage of your order if left unattended at the delivery address.
Collect option
You may purchase from Annandale Cellars and opt to collect your purchase from our physical store, Annandale Cellars, during opening hours.
We will advise you when your order is ready to be collected. Your purchase will generally be available for collection from Annandale Cellars within 12 hours of placing your order.
We will contact you should there be any delay in preparing your order.
Please contact us if you expect that you will be delayed in picking up your order.
